Terms of Service

These Terms of Service (“Terms”) govern your access to and use of FlexPoint's mobile application and website (the “Service”). By creating an account or using FlexPoint, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use FlexPoint. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Your Account

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when creating your account.
• We may suspend or terminate accounts that violate these Terms or our Community Guidelines.

3. Using FlexPoint

FlexPoint allows you to discover events, places, and experiences; buy and manage event tickets; follow communities, businesses, and organizers; and interact with other users. Event organizers and business owners may create listings, promote events, and manage ticket sales.

4. Tickets and Payments

• Tickets purchased through FlexPoint are subject to the terms set by the event organizer, in addition to these Terms.
• All payments are processed through third-party payment providers. FlexPoint does not store your full payment card details.
• Refunds, exchanges, and cancellations for events are subject to the organizer's stated policy.
• FlexPoint may charge service fees on ticket purchases, which will be disclosed at checkout.
• You are responsible for presenting a valid digital ticket for entry validation at events.

5. Content and Conduct

You retain ownership of content you post on FlexPoint, but grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content in connection with operating the Service. You agree to use FlexPoint in accordance with our Community Guidelines and not to:

• Post false, misleading, or fraudulent event or business listings.
• Harass, threaten, or abuse other users.
• Upload content that infringes intellectual property or violates any law.
• Attempt to interfere with or disrupt the Service's security or functionality.
• Use automated means to scrape or access the Service without authorization.

6. Organizer and Business Responsibilities

If you create event or business listings on FlexPoint, you are responsible for the accuracy of your listing, honoring tickets sold, complying with applicable laws (including consumer protection and tax laws), and resolving disputes with attendees or customers.

7. Intellectual Property

The FlexPoint name, logo, app, and underlying technology are owned by FlexPoint and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

8. Third-Party Services

FlexPoint may integrate with third-party services, including payment processors and mapping providers. Your use of those services may be subject to their own terms and privacy policies.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind. FlexPoint does not guarantee the accuracy of event, place, or business listings, or that any event will occur as described.

10. Limitation of Liability

To the maximum extent permitted by law, FlexPoint shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including losses related to events, tickets, or transactions with third parties.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may stop using the Service at any time and request deletion of your account via our Delete Account page.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by applicable laws in the jurisdiction where FlexPoint operates, without regard to conflict of law principles.
